BARNETT, well known and highly esteemed farmer, residing on Stoystown R.D.1, near Ralphton, passed away at his home at 10:00 a.m. on Monday, after having been in declining health for a month, his death coming as profound shock to his host of warm friends throughout this section of the county. Mr. Barnett was a native of Westmoreland County, being born near Idlewild Park, that county, on February 24, 1871 and being aged at time of death 74 years. Mr. Barnett came to this county early in life and followed farming and mining. He was a son of the late Nicholas and Mary (Barnhart) Barnett. On April 3, 1910 he was united in marriage with Miss Annie G. Crist and to the union one daughter - Mrs. Milton Lohr, of Hooversville R.D.1 - was born who, with the widow one granddaughter, LaVonne Louise Lohr, survive to mourn his passing. After reviewing evidence in the case, State's Attorney Lisa Thayer Welch filed an affidavit and criminal information Thursday, resulting in the arrest warrant, the Office of the Garrett County Sheriff reported in a news release. Rush was taken into custody at 10:30 a.m. at his home on Accident-Friendsville Road, the same dwelling where the shooting took place. A spokeswoman at the Garrett District Court Commissioners on Thursday afternoon said Rush's bond was set by visiting Judge Paul Stakem at $50,000. At 7 p.m., Rush was still in the county's detention center. Rush is also charged with using a handgun in a crime of violence and reckless endangerment, the latter because Billie Jo Zimmerman was in the vicinity of the shooting. Zimmerman is described as a former girlfriend of Lancaster, according to Bertha Hale-Cooper, Lancaster's mother, who lives in Oakland. Though originally identified as being from Pennsylvania, Lancaster was living in Maryland at the time of his death, according to Hale-Cooper. Police reports at the time of the death indicated that Rush, Zimmerman and Lancaster were in Rush's home during the early morning hours of Dec. 3, all extremely intoxicated, when Lancaster was said to have stuck a butcher knife into Rush's hand. Rush then reportedly shot a .22-caliber handgun three times at close range, striking Lancaster in the stomach and chest, killing him. "This just came out of the blue this morning," Hale-Cooper said by phone Thursday afternoon. "Detective (J.D.) Murphy called me about 11 a.m. to tell me about the arrest." Hale-Cooper has contended that the Maryland State Police, and not the office of the sheriff, should have investigated the case, because the shooter is the brother-in-law of Sheriff Gary Berkebile. In May, Hale-Cooper, via her attorney Tom Dabney of Oakland, went successfully to circuit court to preserve evidence in the case. The Times-News published a letter Oct. 2 from Hale-Cooper in which she questioned aspects of the investigation and the determination of self defense. A letter to the editor from Berkebile published Oct. 9 responded to Hale-Cooper's comments. "If the state's attorney makes a determination that criminal charges against Mr. Rush will be prosecuted, he will be arrested as soon as possible. In the interest of justice, all parties involved in this tragedy deserve their day in court," Berkebile wrote. "I am so grateful to the Cumberland Times for running my letter," Hale-Cooper said. "I would issue an order with the appropriate claim," Judge Jim Sherbin said at the hearing Monday. "I would issue an order that preserved evidence." Sherbin said that Bertha Hale-Cooper, Lancaster's mother, had not brought the suit against the right agencies, as the sheriff's office, the McHenry Barrack of the Maryland State Police and Garrett County Emergency Management cannot be sued as entities of their own. Instead, he said she needed to bring the suit against the state authorities for these agencies. He added that he understood the need to have the information surrounding her son's death retained. Lancaster, 29, of Saltsburg, Pa., was shot three times with a .22-caliber handgun by Norris Rush, 52, of Accident at Rush's Friendsville Road residence on Dec. 3 after Lancaster reportedly grabbed a butcher knife and inflicted a deep wound to Rush's hand, according to police reports at the time of the incident. H. Scott Curtis, assistant attorney general on behalf of Maryland State Police, questioned the timing of the request, which was made weeks after the shooting, saying that it was unprecedented to request preservation so soon. Tom Dabney, attorney for Hale-Cooper, said there had been question as to the amount of time the 911 recordings could be saved by Emergency Management. Having found out that these are done digitally and can be kept indefinitely, the rush was not as necessary. Dabney also explained that the request was done so that if Hale-Cooper should need to follow through with additional proceedings, she may need such documentation. He also pointed out that because Lancaster's death is still considered a pending investigation, the family has been unable to get a medical examiner's report. He said he felt that calling the investigation pending is incorrect, since the case had been termed a matter of self-defense, according to newspaper articles and others who had spoken to police during the investigation. Dabney said that he had hoped that all possible evidence could be released, rather than simply preserved, since it seems the investigation is already over. Sherbin said that it is not his decision or that of any of the police agencies involved to declare the investigation closed, but that of State's Attorney Lisa Thayer Welch. He said that because there are a number of things to consider in this case, including the fact that Rush is Garrett County Sheriff Gary Berkebile's brother-in-law, it is up to Welch to determine that all aspects of the case have been investigated before it is closed. "It remains under investigation," Welch said concerning the case. She added that in cases such as these, she works with the police agencies to determine if there is enough evidence to proceed with pressing charges. Recently, Sheriff Berkebile wrote to the editor of The Republican about the Maryland State Police withdrawing from GBI. He didn't give any explanation yet for why they did, but he did say: "During its existence, no homicide occurring in Garrett County has gone unsolved." Well I have several questions for him to answer about that statement. My son's death certificate says his death was a homicide. Now I heard homicide is one person killing another. So if that is true, how can Berkebile say that? He and Lisa Welch, the states attorney, are still saying that David's death is still under investigation and that is why I can't find out how my son died. I have had to file two lawsuits to find out what GBI's records show about my son's death and Sheriff Berkebile still refuses to let me see them. If the case is solved, I should be able to see them. QUESTION: Why does Sheriff Berkebile refer to no unsolved homicides in his letter about MSP leaving GBI, if MSP hasn't given him a reason for leaving. Does he know something we don't know? QUESTI0N: Why did Sheriff Berkebile allow Deputy Murphy of the Sheriff's Department to control the investigation when it was the Sheriff's brother-in-law who shot my son and Sheriff Berkebile was there when the EMS arrived? Doesn't he think this is a conflict of interest? Why didn't he let MSP investigate since they were there? I would think he could trust them to be professional and objective since he was MSP before he went to the Sheriff's Dept. Also why did he make the EMS wait outside for 20 minutes to help my son, if he was still alive, and the Sheriff was really interested in my son staying alive? Why has he not filed charges against anyone? Why was my son's body covered with mud and debris if he was shot in the kitchen? Why was my son's body temperature 88.4 degrees a little after 3 a.m., if he was supposedly shot shortly before the 911 call at 2:18 a.m.? Why is this still under investigation 10 months later? Why did the State's Attorney investigator come to my job and tell me that their office has found themselves in quite a predicament because if Norris is charged and found not guilty, my family will be upset, but if Norris is found guilty, then his family will be upset. I didn't think enforcing the law was a popularity contest. I would again quote Sheriff Berkebile's letter to the Republican "Quite frankly, I don't believe the move serves the citizens or public safety well." Yes, as Sheriff, I did respond to the shooting scene last December, the house where it occurred is only a short distance from my own; to do otherwise would have been an abdication of my responsibilities as a sworn police officer. As a father myself, I understand that any perceived delay in arrival of emergency medical personnel is unacceptable. In any emergency medical response to a potential crime scene especially where the possibility of continued violence exists sworn police officers secure the area prior to entry of medical personnel, as was the case here. There was no unnecessary delay in medical care; in fact trained police personnel were administering care to Mr. Lancaster as the home was cleared and the suspect secured. Ms. Cooper has many questions regarding the circumstances of this case, which is understandable. The medical examiner has determined her son's death to be result of homicide; Norris Rush has been identified as the person who fired the shots, yet no criminal charges have been issued. A case is solved when the responsible party has been identified, not necessarily when someone is criminally charged. As noted by Circuit Court Judge James Sherbin, in open court which is part of the official record in this case, the decision whether to charge Mr. Rush in Mr. Lancaster's death rests solely with the State's Attorney, Lisa Thayer Welch. Because the case is still under investigation by the State's Attorney, law prohibits me from releasing the information being sought by Ms. Cooper. I am in full agreement with Ms. Cooper that enforcing the law is not a popularity contest, each and every case, including this one, should be decided on facts, not on who may be "unhappy" with the outcome. The evening Mr. Lancaster was shot Norris Rush left the scene in police custody in handcuffs. If the state's attorney makes a determination that criminal charges against Mr. Rush will be prosecuted, he will be arrested as soon as possible. He also admitted that he did, for all intents and purposes, prevent my son from receiving possible lifesaving help. Why did he need to secure the area if my son was dead and his brother-in-law, Norris Rush, was already in custody? He doesn't offer any specific reason for the delay such as something Norris did to make the scene unsafe. All I know is the rescue squad was not allowed to see if David could have been saved. This is an important question with no answer. He also didn't say how long he had been there before the 911 call was made. Why didn't he call 911 and report the shooting if he was already there performing his "responsibilities as a sworn police officer" instead of making Billie Jo Zimmerman do it? Why did she have to ask the dispatcher how to perform CPR if he was standing there? I was told that Berkebile and Deputy Murphy talked to Norris for sometime before the 911 call was made. I want to know how long they were there and what took so long to secure the crime scene and the suspect, if he is the trained police officer he says he is. My question to the Sheriff is: Why did he need to secure the area from potential violence if my son was dead and he had already determined that the case was one of self defense as he announced through his office in your Dec. 4 and 5 editions and in the Dec. 7 edition of the Garrett County paper. Berkebile didn't respond to my concern about all the mud on the back of David's head and clothes. He doesn't respond to my suggestion that David was dragged inside after being shot to make it look like self defense. He said this case is solved and his investigation is complete. If he has fully investigated these matters, why can't he answer my questions? None of my questions relate to Norris. My questions are about what he, Sheriff Berkebile, did at the scene as "a sworn police officer." He didn't respond to my suggestion that the reason Maryland State Police left GBI was over this case. (I am hopeful MSP will start to investigate this whole matter since they have equal authority to do so in Garrett County). He didn't respond to my suggestion his department had a huge conflict investigating David's death when it was his brother in law who killed him. He didn't answer any of my questions. Instead he chose to make Lisa Welch his scapegoat. It is interesting that he didn't say that he recommended to the States' Attorney that his brother-in-law be charged with first degree murder and she hasn't acted on it. If he had said that, maybe Welch would be a fair scapegoat. I think Sheriff Berkebile misunderstood Judge Sherbin's remarks. I was there and I think what Judge Sherbin was saying was that the court can not force the States' Attorney to do something if she doesn't want to do it. Sheriff Berkebile only tells half of what happened to Norris the day David died. He says Norris was led out in handcuffs. But he didn't tell your readers that two and a half hours after my son died at the hospital, Norris was allowed to go home without any charges. He went home to his home which was no longer a crime scene less than five hours after my son was brutally shot to death there. He also didn't tell you that the family who lost their young son later that same day in a tragic accidental shooting, were not allowed back in their house for two whole days because their home was a crime scene. This case was also handled by Deputy Murphy. That case was closed within a week as an accidental shooting. In closing, Mr. Editor I want to thank you for having the courage and the sense of responsibility to the community you serve, to allow both sides of this important public issue to be aired. Rush was charged with first-degree-murder and using a handgun in a crime of violence for the shooting death of David Wayne Lancaster, 29, of Saltzburg, Pa., in December of 2006. He will also face a charge of reckless endangerment because Billie Jo Zimmerman, Lancaster’s former girlfriend, was in the vicinity of the shooting. The incident on Dec. 3 was originally determined an act of self-defense by authorities at the time. Police reports indicated that Rush, Zimmerman and Lancaster were in Rush’s home on Accident-Friendsville Road during the early morning. All were reportedly extremely intoxicated when Lancaster allegedly had stuck a butcher knife into Rush’s hand. Rush then reportedly shot a .22 caliber handgun three times at close range, striking Lancaster in the stomach and chest, killing him. At 10:30 a.m. on Oct. 4, Rush was arrested on the three charges at his home, the same location of the shooting. Lancaster’s mother, Bertha Hale-Cooper, also successfully went to circuit court with her attorney Tom Dabney to ensure that evidence from the case be preserved. "(Bertha Hale-Cooper) re-quested the full investigation," Carl N. Zacarias, staff attorney for the Civil Litigation Division of the Office of the Attorney General, said. "Our defense is that she is not the person of interest allowing greater record access and the investigation is ongoing." Zacarias, who was representing Garrett County Sheriff Gary Berkebile, said that he felt the request made by Hale-Cooper through her attorney Tom Dabney went against the definition of person of interest. He said that while Hale-Cooper would be allowed access to some aspects of the case, only the person of interest, the person being investigated, would be allowed the full access to the investigation into the shooting death of Lancaster. Hale-Cooper has attempted to get and preserve evidence and information on the investigation from the various parties involved. Zacarias, however, argued that Hale-Cooper's claim that she would be considered the person of interest in this case did not hold up in court, as she is not being investigated in this case, and currently, the person of interest is Rush, who will be facing trial on first-degree murder charges. The case had previously been considered self-defense when Rush reportedly shot Lancaster three times with a .22-caliber handgun at close range when Lancaster allegedly stuck a butcher knife into Rush's hand. Dabney said that because it had originally been determined self-defense, Lancaster would have been considered a person of interest, and as manager of his estate, his mother would be given the access to the investigation as person of interest. Zacarias also argued that because Rush is still pending trial, it could affect upcoming court proceedings if the entire investigation was released to Hale-Cooper and possibly the public. However, with some civil proceedings requiring a time limit, Dabney said that it might not be possible to wait until the case goes to trial. Based upon precedent set in similar cases, Judge Jim Sherbin said that he could not rule that Hale-Cooper was now the person of interest in this case. However, he gave Dabney a week to prepare a memorandum to explain why the previous case was different from this one. David Wayne Lancaster of Saltsburg, Pa., was found lying on the kitchen floor of a residence at 1111 Friendsville Road after deputies responded for a domestic-related shooting. Lancaster was transported to Garrett Memorial Hospital by Northern Garrett Rescue Squad where he was pronounced dead at 4:31 a.m. His body was transported to the Maryland State Medical Examiner's Office in Baltimore for an autopsy, deputies said. Witnesses were interviewed Sunday and the investigation is pending the results of the autopsy. The Garrett Bureau of Investigation and Maryland State Police also responded to the scene. Lt. J.D. Murphy of the Garrett Bureau of Investigation said that 29-year-old David Wayne Lancaster of Saltsburg died at Garrett Memorial Hospital in Oakland after he was shot three times with a .22-caliber handgun fired by Norris Rush, 52. The shooting occurred at 4:31 a.m. in the kitchen of the Rush residence on Friendsville Road after Lancaster grabbed a butcher knife and inflicted a deep wound to Rush’s hand. Rush then discharged the handgun at close range, striking the victim in the stomach and chest. Rush reportedly declined medical treatment at the scene. Police said Billie Jo Zimmerman was also present at the time of the shooting and that all three people appeared to be “extremely intoxicated.” Lancaster, Rush and Zimmerman were said to be friends. Zimmerman was not injured. Police said there was no record of prior domestic complaints at the Rush residence.
